Terms of Service

These terms govern your use of Kromigo, an SMS ordering service that lets a restaurant take orders by text message, answered by an automated assistant. Kromigo is provided by A Singh Who Codes (“we”, “us”). By using the service, either as a restaurant operating an account or as a diner texting a restaurant's number, you agree to these terms.

The service

Kromigo provides restaurants with a phone number their customers can text to browse a menu, build an order, and check out. Messages are answered by an automated assistant using the menu, hours, and other information the restaurant provides. We are a technology provider: the restaurant, not us, is responsible for the food, pricing, fulfilment, and any refunds.

You are texting software, not a person. Replies are generated by an AI model, which means they can occasionally be wrong or misunderstand you. The restaurant sees every order before accepting it, and prices are calculated by our system rather than by the model (see Orders and accuracy). Message content is processed by our AI provider and is encrypted at rest in our systems. Our Privacy Policy sets out exactly what is sent where, and what is not.

SMS messaging program

By texting a restaurant's Kromigo number, or by calling it where the restaurant forwards unanswered calls to us, you consent to receive text messages from that restaurant relating to your order. That includes replies from the ordering assistant and order status updates such as confirmation, an estimated ready time, and “ready for pickup”. If your call couldn't be answered, we end the call and send you a single text saying you can order by text instead; that message carries STOP instructions like any other.

  • Message frequency varies based on your conversation and order activity.
  • Msg & data rates may apply. Your mobile carrier's charges are your responsibility.
  • Reply STOP at any time to unsubscribe from that restaurant's messages. STOPALL (or STOP ALL), UNSUBSCRIBE, CANCEL, END and QUIT work the same way. You'll receive one confirmation and then no further messages.
  • Reply START or UNSTOP to resubscribe.
  • Reply HELP or INFO for help and the restaurant's contact number.
  • Opting out is per restaurant. Sending STOP to one restaurant does not opt you out of another restaurant that uses Kromigo.
  • Carriers are not liable for delayed or undelivered messages.

Note that CANCEL is a carrier-standard unsubscribe keyword, so texting it stops the restaurant's messages. It does not cancel an order you've placed. To change or cancel an order, call the restaurant.

To keep the service affordable for the restaurants that pay for it, there are limits on how many messages one number can send in an hour and in a day. If you reach one, we'll tell you once, say roughly when it lifts, and then stop replying until it does. The limits are set well above what placing an order takes, and don't apply at all while you're part-way through placing one.

Orders and accuracy

The assistant builds orders from the menu and prices the restaurant has configured, and prices are always calculated by our system rather than generated by the assistant. Even so, automated conversation can misunderstand a request. Always review the order summary before confirming. Once you confirm, the order is sent to the restaurant, which decides whether to accept it. Any ready time we text you is the restaurant's own estimate, not a guarantee. Questions, changes, and cancellations after that point are between you and the restaurant. Call them directly, using the number in their HELP reply.

Restaurant accounts

If you operate a restaurant account, you are responsible for keeping your login credentials secure, for the accuracy of the menu, prices, hours, and other information you enter, and for honouring the orders the service delivers to you. You must have the right to use any content you upload. The phone number assigned to your restaurant belongs to us and is assigned for use with the service.

You agree not to use the service to send unsolicited marketing, or to text people who have not first contacted your restaurant by text or call, or in any way that violates applicable messaging laws and carrier rules.

If you switch on missed-call recovery, you are asking us to text people who call your forwarded line. You must forward only calls your own line did not answer, meaning conditional, no-answer or busy forwarding. Never forward every call, which would text people whose calls you did in fact answer. We cap and rate-limit these messages, and may switch the feature off for your account if it is misconfigured.

Fees and billing

Paid plans are billed in advance through Stripe, in Canadian dollars, on the plan and billing interval you choose at checkout. Card details are entered on Stripe's pages and are never handled by Kromigo. Current plan prices and allowances are shown on our pricing page and in your portal's billing screen at the moment you subscribe.

  • Trial. New accounts start with a free trial. Orders taken during the trial are not charged. Unless you cancel before it ends, the plan you selected begins billing automatically.
  • Included orders and overage. Each plan includes a number of orders per billing period. Completed orders beyond that allowance are charged at your plan's per-order overage rate and added to your next invoice. Cancelled orders are not counted, and neither are conversations that don't become an order: questions, hours checks and menu enquiries are never billed.
  • Yearly plans. A yearly plan is charged as a single amount at signup and each renewal. Overage on a yearly plan is invoiced monthly rather than held to the end of the year.
  • Your usage is visible before it is billed. The billing screen shows orders used against your allowance, and the overage accrued so far in the current period.
  • Cancelling. Cancel at any time from the billing portal. Your plan runs to the end of the period you've already paid for, and is not renewed. We don't refund part-periods, and any overage already accrued is still invoiced.
  • Failed payments. If a payment fails we email you and keep your service running while your bank and Stripe retry. If the payment is not recovered, the service stops answering messages until billing is resolved.
  • Price changes. We may change plan pricing. Changes take effect at your next renewal, and we'll tell you before they do.
  • Taxes. Amounts shown are exclusive of any applicable sales taxes, which are added where required.

Availability and liability

The service is provided “as is”. We don't guarantee uninterrupted availability, because messaging depends on carriers and other third parties outside our control. To the maximum extent permitted by law, our liability arising from your use of the service is limited to the amount you paid us in the three months before the claim.

Suspension and termination

We may suspend or close an account that breaches these terms, that puts our carrier registration at risk, or whose payment goes unresolved. You can close your account at any time from the billing portal. On closure we stop answering messages on your number and, on request, will provide or delete your data, subject to records we're required to keep.

Governing law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply in it, without regard to conflict-of-law rules. You and we agree to the exclusive jurisdiction of the courts of Alberta for any dispute arising from the service, except that either of us may seek injunctive relief in any court of competent jurisdiction.

Changes

We may update these terms as the service evolves. Material changes will be reflected in the “last updated” date above; continuing to use the service after a change means you accept it.
